BEVILLES ETERNITY CLUB REWARDS PROGRAM

TERMS & CONDITIONS

INTRODUCTION

1.1 The Bevilles Eternity Club Rewards Program is managed and operated by Fine Jewellery Retail AU Pty Ltd ABN 57 168 234 160 trading as Bevilles Jewellers.

1.2 The Rewards Program allows you to accrue Points which equate to Bevilles Credit. Bevilles Credit can be redeemed in accordance with these Terms and Conditions.

1.3 In these terms and conditions:

"Account” means a Member’s online Bevilles Eternity Club account where Points and Credit will be deposited and that is linked to the Bevilles Eternity Club Card.

"Bevilles" means Fine Jewellery Retail AU Pty Ltd ABN 57 168 234 160 and its related bodies corporate.;

“Bevilles Eternity Club” means those arrangements by which a Member collects and accrues Points and Credit by purchasing qualifying goods and services;

“Bevilles Eternity Club Card” means the electronic or physical membership card issued by Bevilles to Members;

“Credit” means the amounts converted from Points to credit available on a Member’s Bevilles Eternity Club Card for use at Bevilles at the Member’s discretion;

“Database” means the database of Member information held by Bevilles in relation to the Bevilles Eternity Club;

“Member” means an individual who has applied for and been approved by Bevilles for membership of the Rewards Program;

“Participating Bevilles Stores” means the Bevilles stores that participate in the Rewards Program as updated from time to time,

”Rewards Program” means the scheme managed and operated by Bevilles through which Members can collect and redeem Points and Credit in accordance with these Terms and Conditions;

“Terms and Conditions” means these terms and conditions as amended from time to time. 

1.4 These Terms and Conditions form the basis of the Rewards Program. These Terms and Conditions, as varied from time to time, apply to any and all Bevilles Eternity Club transactions, including where a Member uses a Bevilles Eternity Club Card to accrue Points.

2. MEMBERSHIP

2.1 Bevilles employees, corporations, partnerships, trusts and Bevilles’ related bodies corporate, and the employees of those bodies, are not eligible to participate in the Rewards Program.

2.2 A person must apply to become a Member of Bevilles Eternity Club in the manner specified by Bevilles from time to time.

2.3 Membership of Bevilles Eternity Club is only activated upon the earlier of: (a) acceptance by Bevilles of a fully completed written application form; or (b) the Member using a Bevilles Eternity Club Card; or (c) the Member entering into any transaction that would give rise to accruing Points and/or Credit.

2.4 Acceptance of an application to become a Member of Bevilles Eternity Club is in the sole discretion of Bevilles.

2.5 No fees are charged by Bevilles for the issue, registration, activation or use of the Eternity Club, Rewards Program or Membership.

2.6 Bevilles Eternity Club Cards are issued on the basis of one card per Member.

2.7 Bevilles Eternity Club Cards remain the property of Bevilles and may be cancelled and recalled by Bevilles in its reasonable discretion.

2.8 Members must notify Bevilles as soon as practicable of any change to their Member information, including their address and/or email address.

2.9 Members must notify Bevilles as soon as practicable of any lost or stolen Bevilles Eternity Club Card. Bevilles is not liable for any lost or stolen Bevilles Eternity Club Card, any delay in replacing a Bevilles Eternity Club Card or for any unauthorised use of a Bevilles Eternity Club Card or any unauthorised transaction resulting from such use.

2.10 Bevilles may terminate any membership of the Rewards Program if Bevilles reasonably believes that a Member:

(a) fails to comply with these Terms and Conditions;

(b) is suspected of shop-lifting or defrauding Bevilles or the Rewards Program in any way;

(c) abuses any privilege afforded to Members;

(d) wilfully supplies misleading information or makes any misrepresentation to Bevilles in connection with the Rewards Program;

(e) does not use their Bevilles Eternity Club Card during any continuous period of 2 years; or

(f) for any other purpose determined at Bevilles’ reasonable determination.

2.11 Any Member may terminate their membership of the Bevilles Eternity Club at any time by giving written notice to Bevilles and returning the Bevilles Eternity Club Card to any Participating Bevilles Store. Upon receipt of notice of termination to Bevilles from the Member, the Member’s contact details will be recorded on the Database as closed and any accrued Points or other benefits will be permanently forfeited.

2.12 The Bevilles Eternity Club Card is neither a credit nor a debit card and must be used only for identification and recording purposes associated with the operation of the Rewards Program.

3. ACCRUING POINTS AND CREDIT

3.1 Points may only be accrued on eligible purchases made online or instore at Bevilles. Delivery costs, price matched products, insurance sales and Bevilles gift card purchases are not eligible to accrue Points.

3.2 Once the sufficient number of Points have accrued, those Points will automatically be converted into an amount credited to your Account for purchases made by the Member of qualifying goods or services from Participating Bevilles Stores. Your Account may also be credited for promotional and other incentive programs offered by Bevilles from time to time and in its absolute discretion.

3.3 In order for Points to accrue:

(a) when making an online transaction, you must be logged into your Eternity Club Account,

(b) when instore, you must be identified at the time of the purchase by presenting identifying information. Otherwise, the transaction cannot be recorded on your Eternity Club Account and Points cannot be accrued.

Points cannot be granted retrospectively.

or a Bevilles Eternity Club Card must be presented for all transactions including purchases, returns and lay-by deposits made in a Participating Bevilles Store.

3.4 Credit will be credited to your Account in the following manner:

(a) For every $1 spent in a single transaction, you will accrue 0.04 Points. Where a transaction amount is not a whole dollar amount, no Points will be accrued.

(b) For every 10 Points accrued, your Account will be credited with a $10 Credit within 14 days from the date 10 Points have accrued. Credit cannot be purchased and can only be earned through accruing and redeeming Points.

(c) Credit that contributes towards an eligible purchase will be immediately deducted from your Account.

(d) Every 1 Credit dollar can be redeemed for $1 towards payment for an eligible purchase from Bevilles.

(e) Credit can be used as whole or partial payment for eligible purchases depending on the value of the Credit on your Account.

3.5 Bevilles may adjust the Credit balance on your Account to compensate for any amounts credited in error or which have accrued in relation to a transaction that has been cancelled, reversed or refunded or if any suspicious or fraudulent activity has occurred on your Account or your Bevilles Eternity Club Card.

3.6 Points cannot be accrued on transactions involving the redemption of Bevilles credit notes or gift vouchers, or on the redemption of Eternity Club points.

3.7 Points and/or Credit and the rights they confer cannot be sold, transferred, assigned or otherwise dealt with except in accordance with these Terms and Conditions.

3.8 Unless otherwise required by law, Points and/or Credit are non-refundable and cannot be redeemed for cash or gift cards. No interest or any other earnings on the balance of Points and/or Credit will be paid or credited to you by Bevilles.

3.9 Any tax, charges, levies or duty arising from a Member’s membership of the Bevilles Eternity Club is the responsibility of, and payable by, the Member.

3.10 Points will not accrue on layby purchases that are finalised after the due date specified in the layby documents.

3.11 While reasonable effort will be made so that Points are correctly awarded to your Account, Bevilles takes no responsibility for errors associated with crediting Points and/or Credit onto your Account.

4. MEMBERSHIP LEVEL AND ACCRUAL PERIOD.

4.1 There is only one level of membership in the Rewards Program.

4.2 A Member’s total spend on qualifying transactions is cumulative for the duration of the 12-month accrual period. Each qualifying transaction accrues Points that contribute towards the attainment of Credit.

4.3 There is no cap to the number of times that Credit can be earned over a 12-month accrual period.

4.4 The twelve-month accrual period commences on date of first qualifying transaction.

4.5 Credit will be loaded automatically onto your Account at the expiration of each accrual period.

5. REDEEMING CREDIT

5.1 Members cannot combine Accounts from more than one Bevilles Eternity Club Card to receive Points and/or Credit.

5.2 Credit can only be redeemed online or at Participating Bevilles Stores.

5.3 Credit cannot be redeemed until the minimum spend threshold is achieved..

5.4 Unless otherwise specified, Credit cannot to be used in conjunction with any other offer, for existing lay-bys or lay-by payments.

5.5 The Member acknowledges and agrees that any Credit that contributes towards an eligible purchase, and that purchase is subsequently returned to Bevilles by the Member, the Credit will be returned to your Account within 14 days of the return.

6. EXPIRY OF CREDIT

6.1 Any Credit not redeemed by a Member within 12 months from the accrual date will expire and be immediately deducted from your Account.

6.2 On the closure, cancellation or termination of a Member’s account, Points and/or Credit accrued to date will be forfeited to Bevilles. Bevilles is not liable to the Member for the unredeemed balance of the Points and/or Credit or the value of the Member’s unredeemed Points and/or Credit.

7. NOTICE OF CREDIT

A Member can check their Points and Credit balance by contacting Eternity Club on email customerservice@bevilles.com.au or by checking instore at a Participating Bevilles Store. Each Member is responsible to check their own account in relation to the Points and Credit balance and validity of their Credit.

8. MEMBER BIRTHDAY VOUCHER

Birthday vouchers are offered at Bevilles’ discretion to Members from time to time. Birthday voucher terms and conditions apply.

9. MEMBER PRICING

Bevilles exclusively offers Members with Eternity Club Member prices on selected products. Bevilles reserves the right to adjust the Member price at any time.

10. GENERAL

10.1 Bevilles reserves the right to make changes to these Terms and Conditions as our business needs require. Bevilles will take reasonable steps to notify you of material changes (whereby direct communication or by posting a notice on the Bevilles website). If you do not agree to any changes in the Terms and Conditions, please contact us.

10.2 Bevilles reserves the right to make any changes to the scope of eligible goods and services and the number of Points awarded as a result of acquiring such goods and services.

10.3 Bevilles reserves the right to terminate, modify or suspend the Rewards Program in whole or in part at any time in its absolute discretion by giving no less than sixty (60) days’ notice to Members. Bevilles gives no warranty as to the continuing availability of any accrued Points or Credit. Bevilles will not be liable to the Member for the value of the Member’s unredeemed Points and/or Credit.

10.4 Bevilles’ Privacy Policy forms part of these Terms and Conditions and will prevail over these Terms and Conditions to the extent of any inconsistency.

10.5 Any disputes relating to your Account balance must be raised with Bevilles as soon as practicable.

10.6 Points and Credit are not legal tender and cannot be used by any other means other than for payment for products purchased from Bevilles in store or online.

10.7 The laws of Victoria, Australia from time to time governs these Terms and Conditions.

11. BEVILLES ETERNITY CLUB MEMBERSHIP APPLICATION FORM

 The information collected on this application form (including Member’s name, residential, postal (if different) and email address, phone number, Points and purchase details) will be held on a Database maintained by Bevilles and a program service provider engaged by the Bevilles to administer the Bevilles Eternity Club Rewards Program. Information on this database may be used by Bevilles for marketing, planning, product development, research and other commercial purposes, and each Member consents to collection and use for such purposes. Under no circumstances will information be made available to any other parties, unless required by law. If you do not fill out all the information on the application form, we may not be able to provide you with some of Bevilles Eternity Club Rewards Program benefits. Eternity Club Birthday voucher terms and conditions

*Minimum spend of $60 applies for $20 vouchers. Minimum spend of $150 applies for $50 vouchers. Valid at any Bevilles store before expiry date (usually a month after date of issue, expiry will be listed on email). Vouchers can only be used on new purchases (not valid as a payment method on existing laybys or repairs). Your birthday voucher cannot be used in conjunction with any credit or other voucher (not valid for the purchase of gift vouchers). Birthday Vouchers will only be issued if a purchase has been made within a 12-month period. If no purchase has been made within 12 months, no Birthday Voucher will be issued.
